WILL THE POST OFFICE BE LIABLE FOR DEFICIENCY OF SERVICE:
The facts
of this case resemble with those of Department of Post through Sr.
Superintendent of post Office v. M/S. J.K. Daignostics, 1993(2) CPR 591 (SCDRC,
Gujarat). In which it has been laid down that misdelivery of the registered
letter to wrong person is an act of negligence and the post office is liable
for compensation for deficiency of service and the provisions of sec. 6 of the Indian
post office Act, would not be applicable in cases of deficiency in service.
